Cancellation Policy

Cancellation Policy:

1.1 If the Tenant has not moved in or collected the keys to the Room, the Tenant may cancel this Agreement (by giving written notice of cancellation) at any time during the period ending on the date 7 days after the date of this Agreement (the “Cancellation Period"). If the Tenant cancels this Agreement in those circumstances, the Landlord will make one week’s rent charge. 

However, once the Tenant moves in/or collects the keys to the Room, the Tenant loses any right to be released from this Agreement, except where the circumstances set out in clause 1.4 apply. 

1.2 If, after the Cancellation Period, the Tenant wishes to be released from this Agreement, and the Tenant has found a replacement tenant (such tenant to be approved in writing by the Landlord, such consent not to be unreasonably withheld) to take over this Agreement prior to the Tenancy Start Date, the Landlord will release the Tenant from this Agreement on payment of a £50 administration fee to the Landlord.  

1.3 If, after the Cancellation Period, the Tenant wishes to be released from this Agreement but has not found a replacement tenant to take over this Agreement prior to the Tenancy Start Date, then the Tenant will remain liable for the full contractual Rent.  

1.4 If, after the Tenancy Start Date, a replacement tenant is found by the Tenant (such tenant to be approved in writing by the Landlord, such consent not to be unreasonably withheld) or by the Landlord, the Landlord may release the Tenant from this Agreement from the date the new tenancy agreement takes effect, upon payment of a £50 administration fee to the Landlord.  The Landlord reserves the right to move a room allocation where necessary.  

1.5 On the Tenant finding a replacement tenant who is approved in writing by the Landlord the Landlord may require the Tenant to undertake the following as a condition of allowing a replacement tenant:  

1.5.1 Require the Tenant [and/or the Guarantor] to enter into a guarantee of the incoming tenant’s obligations under the Agreement (but only for such a time as the replacement tenant remains a tenant of the Room under the Agreement); and/or 

1.5.2 Require the replacement tenant to provide a guarantor of their own in respect of the obligations of the replacement tenant under the Agreement. 

Summary:

In these circumstances the student will not be held to the tenancy signed. 

• First Year undergraduates – No place at University due to not meeting entry requirements (notification within 7 days of results being received, with evidence) and in advance of the start of contract.

• New International Students - No place at University due to not meeting entry requirements (notification within 7 days of being rejected, with evidence) and by 31 August 

CANCELLATION POLICY UPDATE - COVID-19 – FEBRUARY 2021 

We will continue to be able to accommodate students if University course delivery methods do alter due to the ongoing pandemic. Support to any transfer to online teaching with high-speed internet services in accommodation for access to learning portals, and thorough cleaning of communal areas to ensure our tenants safety while ensuring studies are as undisturbed as possible. Our staff are available to support students living with us, and we are always available to get in touch with 24/7. 

COVID-19 Cancellation 

• If a prospective tenant chooses to cancel their booking before the 31 July due to the coronavirus situation, tenants will not be liable for the contract signed, and only the standard cancellation charge in advance of contract start date of an amount equivalent to one week’s rent will apply 

• Cancellation after 31 July, and in all cases after the contract start date, the prospective tenant will need to find a successor to take over their tenancy agreement or will remain liable for the rental value of the tenancy. 

• If after 31 July the University cancels the course without an alternate offer, or travel to the University city is not possible due to travel restrictions, evidence of either case would need to be provided to the landlord which will be reviewed on a case-by-case basis. This does not apply to change of programme delivery. 

• If through the course of the tenancy the student decides they no longer wish to continue with their tenancy due to a change of circumstances, they will be required to source a successor .

We are monitoring the situation and are regularly in touch with the relevant Universities for updates. This policy revision is accurate at the time of writing but remains subject to change as circumstances change. Where applicable, we will communicate any change directly with the prospective tenant.
